General Terms and Conditions (GTC) of the Ecosocial Forum Austria & Europe

These terms and conditions become part of the contract between the participant (for participants) or speaker (for speakers) and the Ecosocial Forum when they register for an event or order a publication. The participant or lecturer or the person placing the order agrees to the GTC..

1 Scope of application of these general terms and conditions
The general terms and conditions apply to events and publications of the Ecosocial Forum Austria & Europe.

2 Registration for events
Registration can be made online via the website, by e-mail or, depending on the event, by telephone. Further information can be found in the respective event details. The registration deadline can be found in the respective event details.

3 Payment of the participation fee for events
In the event that a participation fee is to be paid, the exact payment conditions can be found in the event details.

4 Cancellation of registration
No course or cancellation fees will be charged for cancellations or no-shows at an event, unless this is explicitly stated in the invitation.

5 Organisational changes/cancellations
The organiser reserves the right to make changes to dates, starting times, speakers, programmes, venues and possible cancellations. In the event of cancellations or changes to the starting times, the registered participants will be informed in good time. Exceptions are cancellations/changes at short notice due to force majeure. No claims for compensation can be derived from cancellations or postponements..

6 Conclusion of contract
The order, which can be placed by telephone, by e-mail or via the homepage, is deemed to be a legally binding offer by the buyer to purchase the ordered goods at the specified price. After receipt of the order, the buyer will receive an e-mail confirming the order and the availability of the ordered goods. Upon sending the confirmation that the ordered goods are available, the purchase contract for the ordered goods is concluded. Free issues of reports, brochures and factsheets as well as a subscription to the newspaper denk.stoff can be ordered by telephone, post or e-mail or, in the case of denk.stoff, via the corresponding form on the website.

7 Delivery of goods
The goods ordered by the buyer will be delivered immediately, in any case within 7 days after sending the confirmation of the order and the availability of the ordered goods. If one or more of the ordered goods are finally no longer available, the Ecosocial Forum can withdraw from the contract for these goods, which will be brought to the attention of the buyer immediately. Available goods will generally be dispatched as part of one delivery; however, if one or more of the ordered goods are not in stock (or available at the time of the order), the Ecosocial Forum is entitled to send the ordered goods to the customer in part deliveries, in which case shipping costs and expenses will be incurred for each part delivery and may be invoiced per part delivery. When subscribing to denk.stoff magazine, the first delivery will be made with the next issue following the order. Older issues can be ordered by telephone, by post and by mail.

8 Retention of title

The Ecosocial Forum retains ownership of the delivered goods until the invoice amount has been paid in full. In the event of the buyer being in arrears with payment of the invoice amount, the Ecosocial Forum is in particular also entitled to withdraw from the contract by setting a reasonable period of grace of 14 days. Notwithstanding this, the buyer undertakes to treat the goods with care and not to damage them until the invoice amount has been paid in full.

9 Right of withdrawal
Buyers who are to be regarded as consumers within the meaning of the Austrian Consumer Protection Act have - subject to the following restrictions - the right to withdraw from the purchase contract within seven working days (whereby Saturdays do not count as working days) from receipt of the ordered goods by the buyer without giving reasons. In the event of exercising a right of withdrawal to which he/she is entitled, the buyer must return the delivered goods to the Eco-social Forum immediately and at his/her own expense and pay the Eco-social Forum an appropriate fee for their use, including compensation for the associated reduction in the fair value of the service. The subscription to our newspaper can be cancelled at any time by telephone, post or email without giving reasons.

10 Prices
All prices shown include VAT at the statutory rate (or as otherwise stated). In addition to these sales prices, shipping and postage costs will be charged at the rate actually incurred. The individual dispatch of free printed material is at the expense of the Ecosocial Forum.

11 Disclaimer
The Ecosocial Forum has compiled all the information provided in publications and Internet pages to the best of its knowledge and belief. However, no liability is accepted for the topicality, correctness and completeness of the information provided, unless the Ecosocial Forum can be accused of intent or gross negligence. Furthermore, the Ecosocial Forum accepts no liability for damage to or loss of personal items belonging to participants or lecturers. Furthermore, any liability that goes beyond the mandatory provisions of the statutory law on damages is excluded.  The use of equipment and machines not provided by the Ecosocial Forum is only permitted with its consent. The person bringing in such equipment and machinery shall be solely liable for any damage caused by its use. No liability claims can be made against the Ecosocial Forum arising from the application of knowledge acquired at the Ecosocial Forum. Participation in events organised by the Ecosocial Forum is always at the participant's own risk. The liability of the Eco-social Forum is limited to intent and gross negligence.

12 Compensation for damages
The inventory, premises, media and equipment of the Ecosocial Forum or rented from it are to be used or treated with care. Participants and lecturers must pay compensation for any damage.

13 Photos/videos
Photographs and videos may be taken at events on behalf of the Ecosocial Forum. The photos and/or videos taken may be used by the Ecosocial Forum for publication and dissemination in connection with the event without any time or place restrictions. By attending the event, participants consent to the publication free of charge, without the need for an explicit declaration by the person concerned. This consent includes the publication of the recordings in print media, in social media, on the website of the Ecosocial Forum and the dissemination via the distribution lists of the Ecosocial Forum as part of an event review. In the case of recordings in which the focus is on individual persons, the participants have the right and the opportunity to inform the photographer or videographer at any time that they do not wish to be recorded. If this is not possible or cannot be taken into account, the Ecosocial Forum undertakes to prevent publication if written notice is given within two days of the event at the latest. Speakers agree to the taking of photographs and films and their publication in social media, on the website of the Ecosocial Forum and dissemination via the distribution list of the Ecosocial Forum as part of the event review. You have the right to prevent publication, provided you give good reasons.

14 Compliance with copyrights
By submitting/providing presentations, the presenter confirms that no third party rights are infringed for all content/photos/graphics/illustrations used within the presentations and that the rights of use are held by the presenter or his/her company. These rights are also transferred to the Eco-social Forum for the use of the content/photos/graphics/illustrations within the framework of the event review.

15 Data protection

Registration system/webshop
All personal details of registrations or participants will be treated confidentially. Participants or speakers accept the automated use of personal data for the processing of registrations and agree to be contacted for confirmation and in the event of queries. The contracting party agrees that his/her personal data such as name, address and email will be stored and agrees to further information or invitations being sent. This consent can be revoked at any time by telephone, post or email. By participating in a funded event, participants agree, by stating their LFBIS number, that personal data (first name and surname, older/younger than 40 years, LFBIS number) will be stored for 10 years and transmitted as evidence upon request of the BMLRT, the EU and other funding bodies. In the case of events that receive recognition as animal health service (TGD) further training and plant protection expert certificates, participants agree that their data (first name and surname, date of birth, address, LFBIS no.) will be passed on to the competent authorities exclusively for the purpose of clarifying the fulfilment of the obligatory further training hours. Within our event offer, functions and contents of the service pretix, offered by rami.io GmbH, Markgräfler Straße 16, 69126 Heidelberg, Germany, are integrated. This includes the ticket shop, which is integrated via a JavaScript widget. When you buy a ticket, pretix uses a technically necessary cookie to enable the ordering process and to remember which shopping cart belongs to you. The cookie is set as soon as you interact with the widget. pretix does not store IP addresses, browser information or other unnecessary meta data beyond the duration of your request. Your personal data will be deleted by us as soon as the purpose of the storage and processing ceases to apply, provided that there is no legal obligation for the longer storage.

If it is necessary to guarantee the aims of the course or event, the Ecosocial Forum Austria & Europe is entitled to exclude participants from the event for objective reasons (e.g. disturbing the event, aggressive or destructive behaviour towards other course participants or lecturers or course leaders) without refunding any participation fee. Exclusion includes non-admission to or expulsion from an event.

19 Membership
Members of the association can become Private individuals, statutory interest groups and independent professional associations, organisations or associations of the The following may become members: private individuals, legal representatives of interests and free professional associations, organisations or associations of the economy, of employees as well as environmental organisations, agricultural and forestry cooperatives and their associations, provinces, regions and municipalities, universities, colleges and their institutions, legal entities of agriculture and forestry, of the credit and insurance industry, of industry, trade and commerce and their organisations, professors, lecturers and assistants at universities, colleges, universities of applied sciences and academies, employees of public administration, interest groups and organisations related to the eco-social model of society, village renewal associations, associations and initiatives for the promotion and implementation of the eco-social market economy. Membership begins with admission by the Executive Board. Membership ends with resignation, exclusion, non-payment of the membership fee over two years, despite a reminder and a grace period of two weeks, or dissolution of a member organisation, in the case of natural persons with death. Resignation must be declared in writing to the Executive Board at least three months before the end of the business year. It becomes effective at the end of the business year. The Executive Board shall decide on expulsion. The financial year shall be the calendar year. Members may participate in general meetings and have the right to vote and stand for election in accordance with the provisions of the Statutes. Members are obliged to pay the membership fee.

20 Jurisdiction
For any disputes arising from these General Terms and Conditions, the place of jurisdiction shall be Vienna.
